Don Roderick Scott appeals from the denial without hearing of his Motion to Vacate Sentence under 28 U.S.C. ? 2255. Scott has been a prisoner in the United States Penitentiary since February 14, 1957. On January 31, 1957, defendant Scott and two codefendants, one his brother, J. Paul Scott, entered pleas of guilty to charges of conspiracy to commit bank burglary and entering a bank with the intent to commit larceny, and to charges of theft of government property worth over $100, and to possession of unregistered machine guns. Both brothers were represented by the same counsel, and both were sentenced to a period of imprisonment totalling thirty years.
